Objection Submission – Residential Flat Building at 42 Donald Street and 5-7 Church Street, Nelson Bay Apartments , Nelson Bay
(SSD – 83366960)

The SSD raises a number of serious, poorly justified non-compliance issues related to the Port Stephens planning standards, policies and strategies that set dangerous precedents for the future integrity of these planning instruments.

The bulk/height and massing of the 9 story Residential Flat building will potentially dominate the significantly elevated street frontages of Church and Donald Streets and may potentially disconnect the harbour views for upstream existing and future buildings (blocked view corridors, reduced permeability) and relates specifically to the non-compliance with LEP height limitations, and the minimal setbacks of the proposed development.

    I cannot believe that such a building with such bulk and height could even be considered at one of the busiest intersections in Nelson Bay. Thank you to TRRA for identifying so many shortfalls. One of particular concern is public safety with large trucks reversing in and out of the building on the side of a steep hill. I witness daily the service vehicles that reverse into a space behind the chemist further down this street and it is absolute chaos. They are only servicing a couple of businesses, not a 55 unit block. The size of bedrooms and the height is quite alarming rendering this apartments only suitable for holiday lets – not the permanent residents they purport to represent that might be interested in living there.
